General Terms and Conditions of Travel – Liberty Moto Travel

These conditions govern the relationship between Liberty Moto Travel of the Motors & Company Suisse group, via S. Balestra 20, CH-6576 Gerra (Gambarogno), and the client.

1. Booking, Tour Confirmation and Cancellation Fees

1.1 The booking of the tour, whether made online or in writing, constitutes a binding contract between the customer and Liberty Moto Travel of the Motors & Company Suisse group.

1.2 Agencies, intermediaries and third parties making bookings on behalf of participants are responsible for ensuring that their clients comply with all contractual obligations towards Liberty Moto Travel.

1.3 The booking is considered confirmed at the moment of the customer’s registration. At the same time, the customer receives confirmation of participation by letter, SMS, WhatsApp or email.

1.4 Services are subject to fare conditions including cancellation, modification or change fees, which may amount to up to 100% of the total amount due.

1.5 In the event that the customer withdraws from the trip, any costs already incurred or non-refundable, including flights, transport, hotel bookings and additional services, shall remain the responsibility of the customer.

1.6 The customer may avoid cancellation penalties if a suitable replacement participant takes over the booking, provided that all travel requirements are met. Any additional costs resulting from changes to flights, transport or other booked services shall remain the responsibility of the original customer. The replacement participant assumes all rights and obligations arising from the contract and shall be jointly liable with the original customer for payment of the tour price and any additional costs.

2. Invoice, Payment and Travel Documents

2.1 Upon registration, the customer automatically receives a PDF document containing general information about the trip.

2.2 The invoice will subsequently be sent by email or letter.

2.3 Payment must be made within the deadline indicated on the invoice.

2.4 The customer must report any failure to receive documents within 24 hours.

2.5 In the event of non-payment within the required deadlines, Liberty Moto Travel reserves the right to cancel the booking and to claim compensation for costs incurred as well as any economic or financial damages resulting from the customer’s breach of contract.

2.6 Cancellation costs, administrative fees and any insurance premiums are immediately payable.

3. Services Provided

3.1 The services provided by Liberty Moto Travel are those described on the website and in the travel documentation. Special customer requests are valid only if confirmed in writing.

3.2 Liberty Moto Travel reserves the right to modify services for justified, unforeseen or substantial reasons.

3.3 Tour guides and intermediaries may not provide guarantees beyond those set out in the contract or make additional agreements.

4. Changes to Services and Prices

4.1 In cases of force majeure, Liberty Moto Travel may modify the itinerary, program or accommodation bookings without compromising the booked tour.

4.2 In the event of increases in transport, fuel, taxes, entrance fees or exchange rate fluctuations, Liberty Moto Travel may adjust the agreed prices accordingly.

5. Exclusion of a Participant from the Tour

5.1 Liberty Moto Travel may exclude a participant from the tour for serious reasons, such as dangerous behaviour, alcohol or substance abuse, or lack of driving fitness. In such cases, no refund shall be granted.

6. Cancellation of the Tour by Liberty Moto Travel

6.1 The tour may be cancelled due to force majeure or failure to reach the minimum number of participants. In such cases, only the amount paid directly to Liberty Moto Travel will be refunded. Any additional expenses incurred by the customer (such as flights, ferries, transport or external services) are non-refundable.

7. Limitation of Liability of Liberty Moto Travel

7.1 During the tour, Liberty Moto Travel shall not be liable for: physical or psychological injuries suffered by the customer / traffic violations committed by the customer / damages caused to third parties / costs or expenses not included in the listed services.

7.2 Before and after the tour, Liberty Moto Travel shall not be responsible for delays, disruptions or accidents related to public or private transport (including flights, trains, buses, taxis or ferries).

7.3 The customer is required to cooperate in preventing or minimising damages. Any issue or irregularity must be reported immediately to the tour guide; otherwise, no liability or reimbursement shall be recognised.

8. Rights, Obligations and Insurance of the Customer

8.1 The customer must comply with all tour regulations and cooperate in the event of interruptions or problems. Failure to do so may result in exclusion from compensation claims.

8.2 The customer is responsible for travelling with valid documents (passport or identity card) and for checking any visa requirements of the destination country.

8.3 Liberty Moto Travel is not responsible for the customer’s personal insurance coverage. Insurance covering trip cancellation, medical expenses, illness and accidents, emergency repatriation, liability and theft is strongly recommended. The customer is responsible for informing themselves about the health regulations applicable in the destination country.

9. Validity and Binding Nature of Website Information

9.1 Information published on the website regarding services, programs, dates, prices and tour conditions forms an integral part of the travel contract. By making a booking, the customer confirms that they have read, understood and fully accepted such information.

10. Disputes

10.1 The Court of Locarno shall have exclusive jurisdiction over any dispute relating to the contract.

AGREEMENT TO THE CONDITIONS

These Terms of Use constitute a legally binding agreement entered into between you, personally or on behalf of an entity ("you") and Motors&Company Suisse sagl SAGL ("Company", "we", "us" or "our"), regarding your access to and use of the website https://www.libertymototravel.com - and any other media form, media channel, mobile website or mobile application related, linked or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agree to be bound by all of these Terms of Use.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to any law or regulation or which would subject us to any registration requirements within such jurisdiction or country. Accordingly, persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is intended for users who are 15 years of age or older. Persons under the age of 15 may not use or register on the Site.

INTELLECTUAL PROPERTY RIGHTS

USER REPRESENTATIONS

USER-GENERATED CONTRIBUTIONS

The Site does not offer users the ability to submit or post content. We may offer you the ability to create, submit, post, display, transmit, perform, publish, distribute, or broadcast content and materials to us or on the Site, including, but not limited to, text, written, video, audio, photographs, graphics, comments, suggestions, personal information, or other materials (collectively, "Submissions"). Contributions may be viewed by other users of the Site and through third-party websites. As such, any Contributions you transmit may be treated in accordance with the Site's Privacy Policy. When you create or make Contributions available, you represent and warrant that:

5. Your Submissions are not unsolicited or unauthorized advertising, promotional materials, pyramid schemes, chain letters, spam, mass mailings, or other forms of solicitation.

6. Your Contributions are not obscene, lewd, lascivious, filthy, violent, harassing, defamatory, libelous, slanderous, or otherwise objectionable (as determined by us).

7. Your contributions do not ridicule, mock, denigrate, intimidate or mistreat anyone. 

8. Your contributions do not advocate the violent overthrow of any government, nor do they incite, encourage, or threaten to physically harm another.

9.Your Contributions do not violate any applicable laws, regulations or rules.

10.Your Contributions do not violate the privacy or publicity rights of any third party.

11. Your Submissions do not contain material that solicits personal information from anyone under the age of 18 or exploits anyone under the age of 18 in a sexual or violent manner.

12. Your Submissions do not violate any applicable child pornography laws, nor are they intended to protect the health or welfare of minors; 

13. Your Submissions do not include offensive comments related to race, national origin, gender, sexual preference, or physical disability.

14. Your Submissions do not otherwise violate, or link to material that violates, any provision of these Terms of Use, or any applicable law or regulation.

Any use of the Site in violation of the foregoing violates these Terms of Use and may result in, among other things, termination or suspension of your rights to use the Site.

WEBSITE AND THIRD-PARTY CONTENT

The Site may contain (or may be sent through the Site) links to other websites ("Third Party Websites") as well as articles, photographs, text, graphics, images, designs, music, sounds, videos, information, applications, software and other content or elements belonging to or originating from third parties ("Third Party Content"). GOVERNESS LAW

These conditions shall be governed by and construed in accordance with the laws of Switzerland, and the use of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. If your habitual residence is in the EU and you are a consumer, you also have the protection provided by the mandatory provisions of the law of your country of residence. Motors&Company Suisse SAGL and you yourself agree to submit to the jurisdiction of the courts in Bellinzona, which means that you may enforce your consumer protection rights in connection with these Terms of Use in Switzerland.

DISPUTE RESOLUTION

Informal negotiations

In order to expedite the resolution and control the cost of any dispute, controversy or claim relating to these Terms of Use (each a "Dispute" and, collectively, the "Disputes"), submitted by you or us (individually, a "Party" and, collectively, the "Parties"), the Parties agree to informally negotiate any Dispute (except for the Disputes expressly provided for below) for at least thirty (30) days prior to commencing arbitration. Such informal negotiations shall commence upon written notification by one Party to the other Party.

Binding arbitration Any dispute arising from the relationship between the Parties is Bellinzona, Switzerland. The language of the proceedings shall be Italian. The applicable rules of substantive law shall be those of Switzerland.

CORRECTIONS

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, prices, availability, and various other information. We reserve the right to correct any errors, inaccuracies or omissions and to change or update the information on the Site at any time without notice.
